The High Court of Cassation and Justice, Administrative and Fiscal Disputes Section, has recently admitted the last appeal filed on behalf of our client and annulled articles 4 para. 4 and 8 of the Government Decision no. 1214/2009, which provided that the state does not grant compensations to the owners of animals sacrificed due to infectious diseases, if such owners were previously sanctioned for contraventional offences (art. 4 para. 4) and if such owners found themselves in any of the situations described in article 8 of the same Government Decision.
The judgment of the Hight Court of Cassation and Justice, which is final and generally mandatory, and due to be published in the Official Gazette of Romania, has upheld our law firm’s interpretation regarding the lack of validity of these legal provisions contained in the Government Decision no. 1214/2009.
As a result of the High Court’s final judgment, articles 4 para. 4 and 8 of the Government Decision no. 1214/2009 will no longer apply to any person in the same situation, thus being finally eliminated an illegally instated barrier against the right to compensations for the affected animal owners, when they have suffered damages as a result of the mandatory slaughtering of their animals, due to outburst of transmissible diseases in their farms.
